These Terms & Conditions (the “Terms”) are a legally binding agreement between American Hooklift by Lizzy Motors LLC (“American Hooklift,” “we,” “us,” or “our”) and each person or entity (“you” or “your”) who accesses or uses our website located at americanhooklift.com and any related pages, content, or services we make available through it (collectively, the “Site”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

Quick Summary (not a substitute for the full Terms): The Site shares general info about our trucks, hooklift systems, roll‑off containers, services, and financing partners. Inventory, specs, prices, photos, and timelines are subject to verification and availability and may change without notice. Written sales documents control over any Site content.

• You must be at least 18 years old (or the age of majority where you live, if higher) to use the Site.
• If you create an account or submit forms, you agree to provide accurate information and keep it current. You’re responsible for maintaining the confidentiality of your credentials and for all activity under your account.
• We may suspend or terminate access to the Site at any time, with or without notice, including if we believe you’ve violated these Terms.

You agree that you will not, and will not attempt to:

• Interfere with, disrupt, or negatively affect the operation or security of the Site or related networks.
• Access any non‑public areas of the Site, our systems, or our suppliers’ systems without authorization.
• Use the Site for any unlawful, fraudulent, infringing, or harmful activity.
• Copy, scrape, crawl, index, or cache the Site or its content (including listings and images) for competitive purposes without our prior written consent.
• Introduce malware or harmful code, bypass security, or probe/vulnerability‑scan the Site.
• Use the Site to post or transmit content that is false, defamatory, obscene, harassing, or that violates third‑party rights (including privacy and IP rights).

• The Site (text, images, videos, guides, FAQs) is provided for general informational purposes only and does not constitute engineering, legal, tax, safety, or financial advice.
• We strive for accuracy, but we do not guarantee that content is complete, current, or error‑free. Specs, capacities, compatibility, availability, incentives, and pricing may change without notice. Photographs may show optional equipment or prior builds; actual inventory/configurations may vary.
• Errors & Corrections. We reserve the right to correct any error, inaccuracy, or omission (including after you’ve submitted an inquiry), and to change or update information at any time without prior notice.

• Invitation, Not an Offer. Listings are invitations to inquire and are subject to prior sale and verification. No contract forms until you receive and accept our written sales agreement.
• Order of Precedence. If there’s a conflict between the Site and your signed proposal/invoice/sales agreement (the “Sales Documents”), the Sales Documents control.
• Specifications & Capacities. Rated capacities/dimensions (e.g., hook heights, hoist/axle ratings, GVWR/GCWR) are based on manufacturer data and typical configs. You are responsible for confirming suitability for your routes, loads, and compliance (including DOT, CDL, bridge laws, axle weight limits, and any emissions restrictions such as CARB).
• Custom Builds & Lead Times. Timelines are estimates and depend on parts availability, shipping, and third‑party work. We may offer substitutions if specified components are unavailable.
• Deposits & Cancellations. Custom builds or special orders may require a deposit as stated on your quote. Unless otherwise stated in writing, deposits apply to the purchase price and may become non‑refundable once parts are ordered or fabrication begins. If we cancel for our convenience, we’ll refund your deposit. If you cancel, refund eligibility is as stated in your Sales Documents.
• Taxes & Fees. Advertised prices typically exclude taxes, title, registration, delivery, and documentation fees unless expressly stated otherwise in a written quote.
• Quote Validity. Quotes are valid only for the period stated on the quote; absent a stated period, quotes expire after 7 days.

• Not a Lender. Financing options are provided by third‑party lenders and are subject to credit approval and their terms. Pre‑qualification or soft‑check tools do not guarantee approval, amount, or rate.
• Info Sharing. If you apply for financing through or in connection with the Site, you authorize us to share your application information with financing partners to process your request.
• Payments. Any payments to us must follow the instructions on your invoice or Sales Documents. We may use third‑party payment processors; your use of those services may be subject to their terms.
• E‑Sign Consent. You consent to transact electronically and to receive/sign estimates, invoices, and Sales Documents by electronic means consistent with ESIGN and UETA. You may withdraw consent by contacting us; doing so may delay transactions.

• Test drives, delivery/shipping, and title/registration services are subject to availability and separate written terms.
• Shipping/delivery dates are estimates, not guarantees. Risk of loss may transfer upon delivery to the carrier, as provided in your Sales Documents.

• Website Content. The Site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non‑infringement, to the fullest extent permitted by law.
• Manufacturer & Seller Warranties. Any product warranties are provided solely by the manufacturer or as expressly stated in your Sales Documents. Nothing on the Site modifies or adds to manufacturer warranties or our Sales Documents.
• Used Equipment. Unless expressly stated in writing in your Sales Documents, used equipment is sold “AS IS, WITH ALL FAULTS,” and we disclaim all implied warranties, to the fullest extent permitted by law.
• Service & Support. Any walkthroughs, training tips, or phone assistance are courtesy guidance only and are not a substitute for professional service or required maintenance by qualified technicians.

• The Site (including text, images, logos, designs, and layouts) is owned by us or our licensors and is protected by intellectual property laws. All trademarks, trade dress, and logos are the property of their respective owners.
• You may view the Site for your personal or internal business use. Any reproduction, distribution, modification, or commercial use of Site content without our prior written consent is prohibited.

• If you submit content (e.g., inquiries, testimonials, photos, or reviews), you represent that you have the right to do so and that your content is accurate, lawful, and non‑confidential.
• You grant us a worldwide, royalty‑free, sublicensable license to use, reproduce, modify, publish, and display your submitted content to operate, improve, and market the Site and our services.
• We may remove or decline to post any content at our discretion.

• By submitting a form or contacting us, you consent to receive communications from us, which may include calls, emails, and text messages (including marketing) to the contact information you provide. Message/data rates may apply.
• You can opt out of marketing texts at any time by replying STOP; for help, reply HELP. Message frequency varies. Carriers are not liable for delayed or undelivered messages.
• Consenting to marketing is not a condition of purchase. Transactional or account‑related messages may still be sent.

The Site may link to third‑party websites or services (including lenders, manufacturers, shippers, or social platforms). We do not control or endorse these third parties and are not responsible for their content, policies, or practices. Your use of third‑party sites and services is at your own risk and subject to their terms.

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and share personal information. If these Terms conflict with the Privacy Policy regarding personal data, the Privacy Policy controls for those issues.

• No consequential damages. To the fullest extent permitted by law, in no event will American Hooklift, its owners, managers, employees, or suppliers be liable for any indirect, incidental, special, exemplary, or consequential damages, or lost profits, arising from or related to your use of (or inability to use) the Site or any content.
• Liability cap. To the fullest extent permitted by law, the maximum aggregate liability of American Hooklift, its owners, managers, employees, and suppliers for all claims arising out of or relating to the Site shall not exceed the greater of one hundred dollars ($100) or the minimum amount required under applicable law.
• The above limits do not limit liability that cannot be excluded under applicable law.

You agree to defend, indemnify, and hold harmless American Hooklift and its owners, managers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site; (b) your violation of these Terms; or (c) your violation of any rights of another person or entity.

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict‑of‑laws principles. You agree that the state and federal courts located in Union County, North Carolina will have exclusive jurisdiction and venue for any dispute arising out of or relating to these Terms or the Site, and you consent to personal jurisdiction in those courts. You waive trial by jury to the fullest extent permitted by law.

Optional Arbitration & Class‑Action Waiver (implement only if desired): Any dispute arising out of or relating to these Terms or the Site will be resolved by binding individual arbitration administered by a reputable arbitration provider under its rules. Class actions and class arbitrations are not permitted. You may opt out of this arbitration provision within 30 days of first use by sending written notice to the contact address below.

The Site is controlled from the United States and intended for U.S. customers. We make no representation that the Site is appropriate or available for use outside the U.S. Accessing the Site from territories where its content is unlawful is prohibited.

We may modify or discontinue all or part of the Site at any time without notice. We may also update these Terms from time to time. When we do, we will revise the “Last Updated” date above. Your continued use of the Site after any update constitutes acceptance of the revised Terms.

• Force Majeure. We are not liable for delays or failures caused by events beyond our reasonable control (including supply‑chain disruptions, labor shortages, strikes, acts of God, or carrier delays).
• Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, sale, or reorganization.
• Severability; Waiver. If any provision is found unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver of our right to do so later.
• Entire Agreement. These Terms, together with our Privacy Policy and any Sales Documents, constitute the entire agreement regarding your use of the Site.
• Notices. We may provide notices via the Site, email, SMS, or to the address you provide. You agree to keep your contact information current.

These notices are for convenience and do not modify any Sales Documents:

• Verification & Inspection. Inspect equipment in person or via a third party and verify measurements, compatibility, and required options for your intended use.
• Compliance. You are responsible for complying with all applicable laws and regulations, including CDL requirements, axle/bridge weight limits, lighting/marking, emissions requirements (including any CARB or local restrictions), and route‑specific limitations.

Maintenance & Safety. Follow manufacturer instructions and required maintenance schedules. Only trained operators should use hooklift systems and roll‑off equipment.
